Writing Agreement

This Writing Agreement (this "Agreement") is effective upon writer's submission, and by and between ADvindicate, Inc., and any writer who submits his or her work for publication. In this Agreement, the party who is contracting to receive the services shall be referred to as "ADvindicate", and the party who will be providing the services shall be referred to as "Writer".

DESCRIPTION OF SERVICE. The writer can submit an article on a solicited or unsolicited basis. Upon submission the writer will provide the following services (collectively, the "Services"): Writer will submit article(s) to ADvindicate on a subject of his or her choice, or if solicited, the choice of ADvindicate. The frequency of the submissions will be decided by the Writer, unless otherwise agreed upon between ADvindicate and the Writer. The Writer will draft the article after a thorough research on the subject and the articles will maintain good standards. Writer will choose to write on subjects that are generally of interest to readers.

PAYMENT FOR SERVICES. ADvindicate, Inc., will pay compensation to Writer for Services in the amount of $100 per article.

RELATIONSHIP OF PARTIES. It is understood by the parties that Writer is an independent contractor with respect to ADvindicate, and not an employee of ADvindicate. ADvindicate will not provide fringe benefits, including health insurance benefits, paid vacation, or any other employee benefit, for the benefit of Writer.

WORK PRODUCT OWNERSHIP. Writer retains the copyright to his articles submitted to ADvindicate, but should ADvindicate decide to publish the article, Writer grants to ADvindicate an exclusive right of publication, which shall extend for a period of 14 days from first publication on the site ("exclusive period").  During the exclusive period, Writer may not publish the article in print or on the Internet.  By submitting an article to ADvindicate, Writer agrees that he may not publish the article elsewhere during the exclusive period.

APPLICABLE LAW. This Agreement shall be governed by the laws of the State of California.
